Please read carefully, the following conditions apply to all bookings when booked direct with the Owner.
1 BOOKING DETAILS
1.1 Any booking mistakes/errors must be notified to the Owner within seven (7) days of booking confirmation.
1.2 A deposit of £100 is due at the time of booking for each week (or short break) booked, with balance 6 weeks prior to arrival, unless otherwise agreed by the Owner. Rental is to be paid in UK pounds or the equivalent on exchange.
1.3 Late availability bookings are for a minimum of 3 nights and bookable a maximum of 4 weeks in advance in peak season. They are booked at the discretion of the Owner.
1.4 The booking will only be confirmed by the Owner following receipt of both the completed booking form together with full payment (the booking form will be sent when a booking request is received).
2 CANCELLATION BY THE HOLIDAYMAKER
2.1 Cancellation requests must be
sent in writing and will be confirmed by the Owner on receipt.
2.2 A full refund of the amount paid, 1.2 above, will be given for
cancellations received in writing more than 60 days before the check-in date, or for a lesser time if the cancellation is due as a result of a legal requirement to not travel (e.g., a pandemic); if the dates are re-sold by the owner; or at the owner's discretion.
2.3 Guests are advised to make their own arrangements for holiday cancellation insurance.
3 OTHER CANCELLATIONS
3.1 If Hook Norton Barn becomes
unavailable for whatever reason, the Owner will give a full refund to the
Holidaymaker.
3.2 The Owner is not liable for any costs associated with alternative
accommodation, which must be paid by the Holidaymaker.
4 RESPONSIBILITIES
OF THE HOLIDAYMAKER
During the period
of the holiday, the Holidaymaker (personally and on behalf of all other people
visiting the Hook Norton Barn) undertakes as follows:
4.1 that the number of people occupying Hook Norton Barn will not
exceed the number stated on the Holiday Confirmation (maximum occupants four, adults only);
4.2 that Hook Norton Barn will be used solely for the purpose of a
holiday;
4.3 to not have pets in Hook Norton Barn;
4.4 to show due consideration for other parties;
4.5 to allow the Owner or his
representative access to Hook Norton Barn at any reasonable time during the
period of the holiday;
4.6 to keep Hook Norton Barn and all the contents in the same state of
repair and cleanliness as at the commencement of the holiday;
4.7 to report as soon as possible any breakages or damage and to reimburse the Owner with the cost of replacement and/or repair;
4.8 to arrive after 4 p.m. on the
arrival day and to vacate Hook Norton Barn by 10 a.m. on the day of departure
unless prior arrangement has been agreed with the Owner and/or the Holiday
Confirmation states otherwise;
5 LIABILITY
5.1 The Holidaymaker's (and all
other members of the Holidaymaker's party's) personal belongings and vehicles
(together with their contents) are left at Hook Norton Barn entirely at their
own risk.
5.2 The Owner shall accept no liability to the Holidaymaker for any
loss, damage or injury howsoever caused to the Holidaymaker or to the
Holidaymaker's personal property (or to persons in the Holidaymaker's party or
their personal property) during their stay at Hook Norton Barn except to the
extent such loss, damage or injury is caused by the negligence or wilful
default of the Owner.
6 COMMUNICATION AND
INFORMATION
6.1 For the purpose of the Data Protection Act 1998, all personal and other information and details collected by the Owner in the course of its business, belong to the Owner and will not be disclosed to any third party.
6.2 If the Holidaymaker or other individual does not wish to receive marketing communication from the Owner, please notify the Owner to this effect.
7 COMPLAINTS
In the unlikely event the Holidaymaker may have cause for dissatisfaction, the Holidaymaker should contact the Owner as soon as possible such that the Owner may attempt to resolve the concerns of the Holidaymaker.
8 FORCE MAJEURE
No liability can be
accepted and no compensation will be paid by the Owner, where the Holidaymaker
or his personal property (and/or any person in the Holidaymaker’s party and/or
their personal property) suffer any loss, damage, injury, disappointment,
inconvenience or otherwise, or where the performance or prompt performance of
any obligations by the Owner are prevented or affected, by any event which the
Owner could not have reasonably foreseen or avoided including war, threat of
war, riot, civil strife, industrial action, terrorist activity, natural or
nuclear disaster, fire, adverse weather conditions, closure of international
borders, disease, pandemic, non- availability of transport services, interruption to
services/utilities and all similar events outside the control of Owner.
9 LAW AND JURISDICTION
All contractual
obligations arising out of these conditions shall be subject to English Law and
the exclusive jurisdiction of the English Courts.
